Article 1. Identity of the seller

Article 2. Applicability

1. These terms and conditions are applicable to every offer by MOTHR EARTH® and every agreement between MOTHR EARTH® and a customer or other buyer via MOTHR EARTH®'s website (hereinafter "customer").
2. An agreement is concluded only after (i) the customer has accepted an offer from MOTHR EARTH®, (ii) MOTHR EARTH® has acknowledged receipt of acceptance of the offer, and (iii) the customer has paid the amount due according to the accepted offer.
3. MOTHR EARTH® has the right to refuse orders, for example if, due to their size, they are obviously not intended for personal use, due to return shipments or due to late payments.

Article 3. Right of withdrawal

1. The customer can dissolve an agreement during a 14-day cooling-off period without giving reasons. To do so, the customer can send an e-mail to retour@mothrearthproof.com to request the return and return the products to MOTHR EARTH® in accordance with the return conditions. There is no possibility to cancel in case of opened, opened and damaged products and packaging.
2. This cooling-off period starts the day after the customer, or a third party designated in advance by the customer, who is not the carrier, has received the product, or:
1. if the customer has ordered several products in the same order: the day on which the customer, or a third party designated by him, has received the last product.
2. if the delivery of a product consists of several shipments or components: the day on which the customer, or a third party designated by him, has received the last shipment or component;
3. in case of agreements for regular delivery of products during a certain period: the day on which the customer, or a third party designated by him, has received the first product.
3. The customer will only receive a refund for products for which the customer has dissolved the agreement within 14 days and which have been received back by MOTHR EARTH® within 14 days after revocation in their original condition and packaging (undamaged and unopened), specifying the information requested on the return form. The customer will return the product with all delivered accessories, and in accordance with the instructions provided by MOTHR EARTH®.
4. The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the customer.
5. The cost of return shipping shall be borne by the customer.

Article 4. Delivery

1. The place of delivery is the address that the customer has made known to MOTHR EARTH®.
2. Taking into account what is stated in article 2 of these general terms and conditions, MOTHR EARTH® will execute accepted orders expeditiously but at the latest within 30 days, unless another delivery period has been agreed upon. If delivery is delayed, or if an order cannot or can only be partially carried out, the customer will be informed about this at the latest 30 days after the order was placed. In that case, the customer has the right to dissolve the agreement without costs and the right to a possible refund.
3. After dissolution in accordance with the previous paragraph, MOTHR EARTH® will refund the amount paid by the customer without delay.
4. In case of delivery outside the Netherlands, the risk of damage and/or loss of products rests with the customer as of delivery to the carrier.

Article 5. Use and liability

1. The products supplied by MOTHR EARTH® are intended to care for facial, neck and cleavage skin. They are not intended and may not be suitable for application in eyes, nose or other orifices of the body. Although purely natural, they are also not suitable for ingestion. MOTHR EARTH® is not liable for any use other than that for which the products are intended.
2. Many of the products supplied by MOTHR EARTH® contain many natural fats and naturally color-containing ingredients and thus may cause color and grease stains. MOTHR EARTH® is not liable for this.
3. The products contain the ingredients listed on the packaging. The customer must check for herself, if she is allergic to them. If so, the customer will not use the product in question.
4. In the event of an unexpected allergic reaction, the customer shall immediately discontinue use and consult a physician. Mothr Earth is not liable for this.
5. MOTHR EARTH® is solely responsible for the quality of its products and the effect of its products on the skin (subject to the provisions of paragraph 3).
6. MOTHR EARTH®'s total liability is limited to an amount equal to the purchase price of the product(s) in question.

Article 6. Late payment, complaints and disputes.

1. If the customer fails to timely fulfill his/her payment obligation(s), the customer, after MOTHR EARTH® has informed him/her of the late payment and MOTHR EARTH® has granted the customer a period of 14 days to still fulfill his/her payment obligations, after the failure to pay within this 14-day period, will owe statutory interest on the amount still owed and MOTHR EARTH® is entitled to charge the extrajudicial and judicial collection costs incurred by MOTHR EARTH®. These extrajudicial collection costs amount to: 15% on outstanding amounts up to €2,500; 10% on the next €2,500 and 5% on the next €5,000, always with a minimum of €40.
2. MOTHR EARTH® makes every effort to satisfy its customers. Should you nevertheless have complaints about her services and/or products, you can reach MOTHR EARTH® via e-mail retour@mothrearthproof.com. The complaint will be dealt with as soon as possible. reviewed, within 8 business days, and efforts will be made to resolve the complaint to the satisfaction of both parties.
3. An agreement between MOTHR EARTH® and a customer is exclusively governed by Dutch law.
